Terms and Conditions of Sale – Tu Sei Mamma
These terms govern the sale of products through the website www.tuseimamma.com (“Site”). By placing an order, the user fully accepts the following conditions.

1. Product Information
• The products offered for sale are maternity and postpartum clothing items.
• Descriptions and images are indicative: slight differences in color or detail do not constitute a defect.
• We reserve the right to modify the products available and their prices at any time, without affecting orders already confirmed.

2. Prices and Currency
• All prices are displayed in Euros (EUR) and include VAT where applicable.
• Prices do not include customs duties, local taxes, or additional charges required by foreign regulations, which remain the customer’s responsibility.
• Prices may change, but will not affect orders already completed.

3. Ordering Process
• An order is considered accepted only after the customer receives an automatic confirmation email.
• If the product is unavailable, the customer will be informed and entitled to a full refund.
• Tu Sei Mamma reserves the right to refuse or cancel an order in case of suspected fraud, misuse of payment methods, or obvious pricing errors.

4. Payments
• Payments can be made using the methods supported by the Shopify platform (credit/debit cards, PayPal, other digital systems).
• Transactions are processed securely with encrypted systems.
• At no time does Tu Sei Mamma have access to sensitive payment card data.

5. Shipping and Delivery
• Shipping is available to Europe, Asia, Oceania, and North, Central, and South America.
• Standard Shipping (Free): order handling within 48 hours, dispatch within 2–4 business days, delivery within approximately 10–15 business days.
• Insured Delivery (€7.50): ensures priority handling, advance refund in case of loss, and dedicated support.
• Delivery times are indicative: any delays caused by external factors (customs, strikes, weather conditions) are not attributable to Tu Sei Mamma.

6. Right of Withdrawal and Returns
• Customers may exercise their right of withdrawal within 14 days of receiving the order, pursuant to the Italian Consumer Code (Legislative Decree 206/2005).
• Products must be returned intact, unused, and in their original packaging.
• Return shipping costs are borne by the customer, unless the product is defective or incorrect.
• The return procedure must be initiated by writing to: info@tuseimamma.com.

7. Refunds
• Refunds will be processed within 20 business days of receiving and verifying the returned product.
• Refunds will be issued using the same payment method used for the order.
• If the return occurs after one or more size exchanges, the refund will be reduced by the logistical costs borne by Tu Sei Mamma (€8.50 per shipment).

8. Size Exchange
• A size exchange can be requested within 14 days of receiving the order.
• The first size exchange is free of charge for each item.
• From the second exchange of the same item onward, a fee of €7.50 will be applied to cover handling and logistics.

9. Defective or Incorrect Products
• If the customer receives a defective or incorrect product, Tu Sei Mamma will cover all return and replacement shipping costs.
• The issue must be reported within 14 days of receipt.
• After verification, the customer may choose between replacement or refund.

10. Legal Guarantee of Conformity
• All products are covered by the Legal Guarantee of Conformity for 24 months from delivery, pursuant to EU Directive 771/2019 and the Italian Consumer Code.
• Defects must be reported within 2 months of discovery.
• In case of a defect, the customer is entitled, at no cost, to repair, replacement, or refund.

11. Limitation of Liability
• Tu Sei Mamma is not responsible for delays or service disruptions caused by force majeure or circumstances beyond its control.
• We are not responsible for additional costs arising from duties, local taxes, or customs procedures in the destination country.

12. Governing Law and Jurisdiction
• These Terms of Sale are governed by Italian law and European regulations.
• For disputes, jurisdiction lies with the consumer’s place of residence or domicile, in accordance with applicable legislation.
